As your supplying dealer we have certain responsibilities under the Sale of Goods Act 1979 to deliver your new vehicle as described and fit for purpose and of a satisfactory quality. The aim of this guarantee is to extend your guarantee to cover faults that may develop after delivery of your vehicle.
Please read this document carefully and make sure You understand and fully comply with its terms and conditions. Failure to do so may jeopardise the payment of any claim which might arise and could lead to the guarantee becoming void. Please ensure You keep it in a safe place so You can read it again if You need to.
This document contains details of the cover You have, what is excluded from the cover and any conditions that apply.
This Guarantee does not cover maintenance, components failing due to wear and tear, components which are not covered as shown in the terms and conditions or vehicles which are used for hire or reward.
Please ensure You comply with the service requirements as detailed in the General Conditions section of this book.
The Guarantee Details
This must be kept with the guarantee book and contains Your details, details of the vehicle, the level of cover provided by the guarantee.
Please check that the information contained in the schedule is correct.
Legal Rights
This guarantee is in addition to Your legal rights.
The Law Applicable to this Contract: Your guarantee will be governed by the law of England and Wales unless You and we have agreed otherwise.
This guarantee is administered on behalf of Your selling dealer by Lumley Warranty Services Ltd, 4 Copthall House, Station Square, Coventry, CV1 2FL.
Definitions
Any word or expression to which a specific meaning has been attached will bear the same meaning throughout this guarantee and will appear with a capital letter and in bold.
Administrator means Lumley Warranty Services Limited, 4 Copthall House, Station Square, Coventry, CV1 2FL.
Component means any Mechanical, Electrical and Electronic part, which forms part of the Vehicle’s original specification, covered under the relevant Level of Cover of this policy
GeographicalLimits means the area in which this guarantee is effective and are Great Britain, Northern Ireland, the Isle of Man and the Channel Islands
Indemnity and Indemnified means that if We pay to have Components of YourVehicle replaced resulting in them being in a better condition than they were before the Breakdown, You may be required to pay a contribution towards the costs
Mechanical / Electrical Breakdown means the sudden and unforeseen failure of a component arising from any permanent mechanical or electrical defect, (for a reason other than wear and tear, normal deterioration or negligence) causing a sudden stoppage of its function, necessitating immediate repair or replacement of its component before normal operation can be resumed
Level of Cover means the section of cover as stated in Your guarantee schedule
Cover Period means the dates shown on the guarantee schedule
Proposal means any signed proposal and declaration together with any additional information You may have supplied to Us in support of Your application for this guarantee
Repair Cost means the cost of both repair materials and labour (including VAT where appropriate) necessitated in rectifying the Breakdown
Repairer means any full-time business providing a car repair service
Replacement Cost means the cost of replacement Components of similar make and quality as the Component that had suffered Breakdown, including the labour cost of fitting the new Component, in line with part manufacturer list prices
Servicing Handbook means the handbook which was issued with the Vehicle as identified on the guarantee schedule for private use (excluding taxis, private hire, courier services, haulage or transportation of goods and motor cycles) for use on the public highway and designed to carry no more than eight people including the driver to small commercial vehicle of less than 3500kg gross weight
Single Claim Limit is the maximum amount that can be claimed per Breakdown during the Cover Period
Overall Claim Limit is the maximum amount that can be claimed during the cover period
Vehicle means only the Vehicle as identified on the guarantee schedule for private use (excluding taxis, private hire, courier services, haulage or transportation of goods and motor cycles) for use on the public highway and designed to carry no more than eight people including the driver or small commercial vehicle of les than 3500kg gross weight
We / Us / Our means the dealer who sold you the Vehicle
Wear and Tear means the gradual deterioration associated with normal use and age of the Vehicle and its Components
Worn Out describes Components which have reached the end of their normal effective working lives because of age and / or usage
You / Your / Yourself means the owner / driver named in the guarantee schedule
